2. Scope of Application, Definitions
2.1 These General Terms and Conditions (GTC) apply to all orders placed via our online shop (sealit.shop / sealit.at and related shop domains) in the version valid at the time of the order.
2.2 Consumer means any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity.
Business customer (entrepreneur) means a natural or legal person or a legally capable partnership who, when entering into the contract, acts in the exercise of their commercial or self-employed professional activity.
2.3 Deviating terms of the customer shall apply only if we have expressly agreed to them in writing.
3. Conclusion of Contract
3.1 The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
3.2 By clicking the button “Place order with obligation to pay” (or equivalent), you submit a binding offer to purchase the goods contained in the shopping cart.
3.3 A purchase contract is concluded when we accept your order by an explicit declaration of acceptance (e.g., order confirmation) or when we dispatch the goods or confirm handover to the shipping service provider.
3.4 We reserve the right to reject orders, e.g., in the event of non-availability, obvious price/product errors, or suspected misuse.
4. Contract Language, Storage of the Contract Text
4.1 The contract language is German.
4.2 We will send you the order confirmation and relevant contract information by email. You can access these GTC at any time in the shop.
5. Prices, Shipping Costs, Delivery within the EU Only
5.1 All prices are final prices in euros incl. statutory VAT (unless expressly stated otherwise).
5.2 Shipping costs are shown separately during checkout.
5.3 We deliver exclusively within the EU to the delivery countries selectable at checkout. Delivery to territories outside the EU / overseas territories may be excluded.
6. Payment Methods
6.1 The payment methods shown at checkout are available. Depending on the payment method, your account will be charged immediately or in accordance with the payment provider’s terms.
6.2 If you select payment service providers (e.g., PayPal, Klarna, credit card), their additional terms may apply.
7. Delivery, Delivery Times, Transfer of Risk
7.1 Stated delivery times are non-binding guidelines unless a fixed date has been expressly confirmed.
7.2 Transfer of risk (consumers): For consumers, the risk of accidental loss or accidental damage to the goods passes only upon delivery to the consumer (or to a third party designated by the consumer who is not the carrier).
7.3 Transfer of risk (business customers): For business customers, the risk passes upon handover to the shipping service provider / carrier, unless otherwise agreed.
7.4 In the event of delay in acceptance or other culpable breach of cooperation obligations by the customer (e.g., incorrect address), additional costs (e.g., return shipping costs charged by the carrier, reshipment) may be charged to the customer.
8. Retention of Title
8.1 The goods remain our property until full payment has been made.
8.2 For business customers, retention of title applies until full settlement of all claims arising from the ongoing business relationship.
9. Statutory Right of Withdrawal (Cancellation) for Consumers – 14 Days
9.1 Consumers generally have a statutory right of withdrawal (right to cancel).
9.2 Information on the Right of Withdrawal
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
Withdrawal period
The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods. In the case of partial deliveries: from receipt of the last goods/partial shipment.
Exercising the right of withdrawal
To exercise your right of withdrawal, you must inform us (WMI GmbH, Hofgasse 5, 2201 Seyring, Austria, email: support@sealit.shop) by means of a clear statement (e.g., email) of your decision to withdraw.
You may use the model withdrawal form in section 9.5, but this is not mandatory.
To meet the deadline, it is sufficient for you to send the notification of exercising the right of withdrawal before the withdrawal period expires.
9.3 Consequences of Withdrawal
If you withdraw from the contract, we will reimburse you all payments received from you, including delivery costs (except for additional costs resulting from your choice of a different type of delivery than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we received notice of your withdrawal.
We may refuse reimbursement until we have received the goods back or until you have provided evidence that you have sent back the goods, whichever is the earlier.
9.4 Return in the Context of Withdrawal / Return Shipping Costs
You must send back the goods without undue delay and in any event no later than 14 days from the day on which you informed us of the withdrawal.
You bear the direct costs of returning the goods.
Return registration: If possible, we ask you to register the return via our returns form. (Using the form is not required for an effective withdrawal, but it facilitates processing.)
Important: The withdrawal must be made by a declaration (e.g., by email); merely returning the goods without a withdrawal declaration is not sufficient.

9.6 Exclusion or Expiry of the Right of Withdrawal (Where Provided by Law)
The right of withdrawal does not exist, among other things, or may expire for:

goods made to customer specifications or clearly tailored to personal needs,

sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery,
-
goods which were inseparably mixed with other goods after delivery.
10. Voluntary Return – 30 Days from Delivery (Additional, Not Instead of Statutory Rights)
10.1 In addition to the statutory right of withdrawal, we offer consumers a voluntary return option of 30 days from delivery (“30-day return”). This voluntary service applies only to orders placed via our online shop.
10.2 Conditions of the 30-day return:

The goods should be returned, if possible, unused, complete, and undamaged.

A return may be excluded if a product is not suitable for return for hygiene or health protection reasons, was sealed accordingly, and the seal has been removed.

The goods should, if possible, be returned in suitable packaging; original packaging is preferred but – unless otherwise required by law – not mandatory, provided the goods are not damaged as a result.
10.3 Return shipping costs: For the 30-day return as well, the customer bears the direct return shipping costs.
10.4 Process: The 30-day return must be registered via our returns form.
10.5 Your statutory warranty rights (section 11) remain unaffected by the 30-day return.
11. Warranty / Rights in Case of Defects
11.1 The statutory warranty/defect rights apply.
11.2 In particular for consumers: We are liable for ensuring that the goods conform to the contract at the time of delivery. The warranty period is generally 2 years from delivery (subject to statutory exceptions). Any statutory rules on the burden of proof remain unaffected.
11.3 For business customers: The business customer must inspect the goods immediately upon receipt and notify us in writing of any apparent defects without undue delay; otherwise the goods shall be deemed approved.
11.4 Any manufacturer warranties exist only if expressly stated for the goods. Statutory rights are not restricted thereby.
12. Liability
12.1 We are liable without limitation for damages caused by intent or gross negligence as well as for personal injury.
12.2 In cases of slight negligence, we are liable only in the event of a breach of essential contractual obligations (cardinal obligations) and limited to the damage typically foreseeable.
12.3 Mandatory statutory liability provisions remain unaffected.
13. Product Displays, Availability
13.1 We endeavor to provide product displays as accurate as possible. Deviations (e.g., colors/appearance due to screen display) are possible.
13.2 We may continuously adjust product descriptions and the scope of our assortment. Errors and omissions excepted.
14. Vouchers and Promotions
14.1 Discount codes/vouchers apply only within the specified period and under the conditions communicated in each case.
14.2 Unless otherwise stated, vouchers cannot be combined and can be redeemed only once per order / customer.
15. Data Protection
Our privacy policy applies in the current version (available in the shop). Personal data will be passed on to required service providers (payment, shipping) for order processing.
16. Final Provisions
16.1 Choice of law: Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of mandatory consumer protection provisions of the state of their habitual residence.
16.2 Place of jurisdiction:

For consumers, the statutory places of jurisdiction apply.

For business customers, to the extent permissible, the place of jurisdiction is the registered office of WMI GmbH.
16.3 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
